• Note (General): type:text; 世界経済は、COVID-19によって大きな悪影響を受けた。特に、多くの企業は、サプライ・チェーンの崩壊によって、深刻な原材料不足に陥った。また、原材料費、燃料費の高騰によって、製造業のビジネスモデルは、大きな転換を迫られている。さらに、ウィルス防御のための防御具、医療器具及び医薬品のような資源は、深刻な供給不足に陥った。自由競争経済体制では、需要の逼迫は、価格の上昇を生み出すことになる。しかし、国民の生命、健康の安全のため、価格の高騰を抑止するだけでなく、病院、医療機関に対する優先的な供給が必須となる。 そのためには、医療器具、医薬品及び生活必需品を製造、販売する事業者間での協調行動を容認する必要がある。欧州委員会は、非公式なコンフォートレターをコンプライアンスに懸念を有している企業に対して提供し、米国は、適切なパンデミックにおける強調行為を促進するため、協調行動を行おうとする企業に対するbusiness review letterを早期に発行した。これに対して、日本では、不況カルテルや合理化カルテルの適用除外を廃止していることから、緊急事態に対して、公正取引委員会と事業者との間の事前相談が重要となる。 本研究では、公取委の事前相談事例及びその動きを米国、欧州委員会の活動と比較した。共同行為について、公取委の認識と諸外国の競争法当局との認識に大きな違いはなかった。特に、協調行動が容認されるのは、「物資の不足を回避するために行われる必要かつ一時的な行為」であれば独占禁止法問題とならないと指摘する。東日本大震災のときの同様の判断枠組みが示されている。米国、欧州に比べ、東日本大震災の経験、例えば計画停電などの知見が今回の対応に生かされていることがわかった。これに加え、日本の特徴として、中小・下請事業者へのしわ寄せに対する対応、そして不当な高価格設定に対する消費者利益の侵害に対する関心が強いことがわかる。今回の研究を通じ、非常時における競争政策は、物価対策や経済活動全体の安全保障の確保といった様々な保護法益を調整する必要があること、そして、COVID-19収束後であっても、引き続き、この問題について、適切な法的枠組みを検討する必要があることが判明した。この研究成果を踏まえて、危機的状況から見た経済活動における競争のあり方を研究する必要性が明白となった。 The global economy was severely adversely affected by COVID-19. In particular, many companies suffered severe raw material shortages due to supply chain disruptions. In addition, the rising costs of raw materials and fuel have forced manufacturers to make major changes in their business models. In addition, resources such as personal protective equipment products and pharmaceuticals have fallen into serious shortages. In a free and competitive economic system, tight demand would create higher prices. For the safety of people's lives and health, it is essential not only to deter price hikes but also to give priority to supply hospitals and medical institutions. To this end, it is necessary to allow cooperative behavior among businesses that manufacture and sell medical devices, pharmaceuticals, and daily necessities. The European Commission has provided informal comfort letters to companies with compliance concerns, and the United States have issued early business review letters to companies seeking to engage in concerted action to facilitate appropriate pandemic highlighting. In contrast, Japan has abolished exemptions for recession cartels and streamlining cartels, making prior consultation between the Fair Trade Commission and businesses important in response to emergency situations. In this study, we compared the JFTC's prior consultation cases and its activities with those of the U.S. and the European Commission. There was no significant difference between the JFTC's perception of joint actions and that of competition law authorities in other countries. In particular, the JFTC pointed out that concerted action is acceptable if it is "a necessary and temporary act undertaken to avoid a shortage of goods" and does not constitute an antitrust problem. A similar decision framework is presented for the Great East Japan Earthquake. Compared to the U.S. and Europe, the experience of the Great East Japan Earthquake, e.g., rolling blackouts, was found to have been utilized in the response this time. In addition to this, it can be seen that Japan is characterized by a strong concern for responding to wrinkles in small and medium-sized businesses and subcontractors, as well as for infringement of consumer interests against unreasonably high pricing. Through this study, it was found that competition policy in times of emergency needs to coordinate various protective legal interests, such as price measures and ensuring the security of overall economic activities and that even after the COVID-19 convergence, it is necessary to continue to consider an appropriate legal framework for this issue. Based on the results of this research, the need to study the nature of competition in economic activities in view of the crisis situation became obvious.
