- 出版タイプ： NA平成11年度～平成12年度科学研究費補助金(基盤研究(C))研究成果報告書研究種目:基盤研究(C) 研究種目コード:320研究課題番号:11620019審査分野:一般 区分コード:03公的組織と民間営利企業の中間にある組織としてのNPOが、日本社会において法的な存在として認知されていく立法過程が明らかにされた。行政官僚によって作成された原案を元にした政府提出法案というわが国において通常見られる立法過程ではなく、議員立法活動に因を発したNPO法の立法過程の分析を通じて、市民活動に端を発して法律が制定されていくという新たな可能性が示された。介護、交通安全、社会教育、防災などの具体的な社会政策施行の中で、NPOが既存の行政組織、法体系の中で、どのような役割を担っていくかについての予測・分析が行われた。現在、NPOについては、法人事業税の減免税問題が検討されている。それぞれの分野のNPOが減免税の対象となるかは、NPOが行う事業が、社会において果たす公益的役割の評価、他方において、徴収した税を財源として、行政機関が公的施策として行う事業の場合との、多方を比較する作業を行うことが前提となる。本研究は、そのような作業のための足がかりとなる分析を行っている。地方分権法制の大改革に伴い、都道府県・市町村に委ねられる自治事務の範囲が大幅に拡大する中で、地方自治体の政策法務の一環としてNPOによる自治的な行政を織り込むあり方が、いくつかの事例を踏まえて検証された。別刷論文(p.55-68)削除
