Steven Gow Calabresi. The history and growth of judicial review. Oxford University Press, [2021]. ISBN:9780190075774; 9780190075736<br>"This book examines the origins and growth of judicial review in the key G-20 constitutional democracies, which include: the United States; the United Kingdom; France; Germany; Japan; Italy; India; Canada; Australia; South Korea; Brazil; South Africa; Indonesia; Mexico; and the European Union. The book considers five different theories, which help to explain the origins of judicial review, and it identifies which theories apply best in the various countries discussed. It considers not on what gives rise to judicial review originally, but also what causes of judicial review lead it to become more powerful and prominent over times. The positive account of what causes the origins and growth of judicial review in so many very different countries over such a long period of time has normative implications"--

David T. Johnson. Japan's Prosecution Review Commission : on the democratic oversight of decisions not to charge. Palgrave Macmillan, [2022]; ©2022, Palgrave advances in criminology and criminal justice in Asia. ISBN:9783031193729; 3031193725<br>This book explains Japan's unique Prosecution Review Commission (PRC) which is composed of eleven people selected randomly from voter registration lists. The PRC reviews non-charge decisions made by professional prosecutors and determines which cases should be reinvestigated or charged. PRCs also provide prosecutors with general proposals and recommendations for improving their policies and practices. The book analyzes the history and operations of the PRC and uses statistics and case studies to examine its various impacts, from legitimation and shadow effects to kickbacks and mandatory prosecution. More broadly, this book explores a problem that is common in many criminal justice systems: how to hold prosecutors accountable for their non-charge decisions. It discusses the potential these panels have for improving the quality of criminal justice in Japan and other countries, and it will appeal to scholars and students studying prosecution and democracy, criminal justice, criminology, lay participation, justice reform, and Japanese studies. David T. Johnson is Professor of Sociology, University of Hawaii at Manoa, USA

Phillipa K. Chong.. Inside the critics' circle : book reviewing in uncertain times. Princeton University Press, [2020], Princeton studies in cultural sociology. ISBN:9780691167466; 069116746X<br>Taking readers behind the scenes in the world of fiction reviewing, Inside the Critics' Circle explores the ways that critics evaluate books despite the inherent subjectivity involved, and the uncertainties of reviewing when seemingly anyone can be a reviewer. Drawing on interviews with critics from such venues as the New York Times, Los Angeles Times, and Washington Post, Phillipa Chong delves into the complexities of the review-writing process, including the considerations, values, and cultural and personal anxieties that shape what critics do. Chong explores how critics are paired with review assignments, why they accept these time-consuming projects, how they view their own qualifications for reviewing certain books, and the criteria they employ when making literary judgments. She discovers that while their readers are of concern to reviewers, they are especially worried about authors on the receiving end of reviews. As these are most likely peers who will be returning similar favors in the future, critics' fears and frustrations factor into their willingness or reluctance to write negative reviews. At a time when traditional review opportunities are dwindling while other forms of reviewing thrive, book reviewing as a professional practice is being brought into question. Inside the Critics' Circle offers readers a revealing look into critics' responses to these massive transitions and how, through their efforts, literary values get made. --

The equilibrium of parliamentary law-making : comparative perspectives on the role of courts in a democracy / Viktor Kazai

Viktor Kazai. The equilibrium of parliamentary law-making : comparative perspectives on the role of courts in a democracy. Routledge; Routledge, 2025; ©2025, Routledge research in public law. ISBN:9781032746463; 1032746467<br>"This book is a response to the dangers posed to constitutional democracy by the continuous growth of executive power and the simultaneous decline of parliaments' role in policy formation. These phenomena are often manifested in the manipulation and even the violation of the rules of parliamentary law-making, called irregularities. If left without consequences, these irregularities can ultimately lead to the elimination of the procedural constraints imposed on the ruling political forces to prevent their arbitrary exercise of power. This work investigates the constitutional significance of the irregularities of parliamentary law-making and explores the role that courts play in the remedy of these flaws. The analysis is premised on the concept of equilibrium. This explanatory concept denotes an ideal state in which parliamentary law-making complies with the requirements of constitutionalism, and judicial review is conceptualized as a mechanism suitable to achieve this aim. The volume places the judicial review of the regulation and the practice of parliamentary law-making at its centre and discusses all the relevant legal concepts, institutions and doctrines. It combines theoretical analysis with case-law-centered comparative research covering a large number of decisions delivered by apex courts operating in various jurisdictions. Due to this methodological choice, the book aims to simultaneously contribute to the scholarly discourse and provide useful information to practicing lawyers and policy makers working in the areas of Constitutional Law and Politics and Comparative Law"--

These are some of the questions that any citizen in a democratic country should know in order to enjoy his/her freedom and rights. Even a small country like Albania is no exception. New and modern Constitutions, aim to regulate the exercise of state power, based on the principle of separation of powers and to the respect for human rights and fundamental freedoms. Despite the fact that this important principle helps to control the activity between different state institutions, the history has shown that this has not always been an efficient solution. So, the world is full of examples where a parliamentary majority, that have come to power through democratic processes, has used its power to control the others power of a country and had violated the human rights and fundamental freedoms. For this reason, the drafters of the constitution after the Second World War in Western Europe and after the fall of communism in Eastern European countries, have established and regulated the creation of the Constitutional Court as an institution which can defe; nd the sphere of the competencies of other institutions with constitutional nature and the protection of human rights and fundamental freedoms. This possibility can only be realized using procedural means, through which the Constitutional Court is put into motion. The purpose of this book is precisely, to analyze these procedural mechanisms with regard to the principles of the constitutional process, the jurisdictions, the admissibility of the applications, the procedural position of the parties, the terms and their calculation, procedural acts and evidence that can be used, as well as, procedural characteristics for each constitutional process. A good knowledge of these principles and rules of procedure helps the different applicants who presented themselves to the Constitutional Court to have higher chances to succeed and to be accepted instead of being dismissing because of procedural deficiencies.
