• 一般注記: 論文; Article; 基本的人権の尊重を中核に据えた世界で最初の近代成文憲法の典型はアメリカ合衆国憲法であると言われている。それは、イギリスにおいて17世紀中葉の挫折したピューリタン革命の「未完に終わった」憲政改革の完成を目指したピューリタンを中心とする移民が創出した北米の英領植民地の特異な政治制度にその起源を有する。日本国憲法はアメリカ合衆国憲法の基本的原則の影響を受けており、多くの種類の憲法の中で同じ方向性にある憲法であるので、アメリカ憲法の起源になる政治制度の理解は現行の日本国憲法の在り方を考える上で有意的であると思われる。そこで、本稿では、まずアメリカ憲法の全体を解明する第一歩として英領植民地の特異な政治制度の概観を試みることにしたい。; It is said that the typical first written modern constitution in the history of world is the Constitution of the United States of America which was made by the political representatives of 13 English Colonies. These colonies were established by the people, particularly Puritan who tried to reform the semi-absolute monarchy into republic, but failed after their short reign at the middle of 17 century in England. Small radical religious group of the Puritan who immigrated into colonies of western part of north America had aimed to accomplish the unfinished reform of English political system. Its result was the political institution peculiar to the English Colonies. The Constitution of the United States of America is actually the development of this political institution. Japanese Constitution belongs to the same category of the American Constitution. In my view, it is relevant for us to understand the formative process of the political institution peculiar to the English Colonies, in order to grasp the distinct character of the Japanese Constitution. Therefore, in this article, I try to follow the growth of American political institution in English Colonies as the first step to understand the character of the American Constitution.
