• 一般注記: 出版タイプ： VoR; type:text; 人権論に関しては, 国際人権条約機関の意見と国内裁判機関との関係を解明し, また国際的な家族関係をめぐる新たな法的課題に対応する手法について検討した。公法理論に関しては, グローバル化が公法学のパラダイムにとってどのような影響を与えているかを解明した。行政法では, 行政過程における民主主義的正当性を解明した。刑事法では, 各国の文化的・宗教的相違をふまえた法規制のあり方を検討した。商事法では, 国家法に代替する秩序について検討した。基礎理論では, 比較衡量こそ現在グローバル化している法的思考様式であることを明らかにした。グローバル化の下の法学教育については, 法整備支援・教育の意義を明らかにした。 With respect to human rights theory, we examined the relationship between International human rights treaty organizations and domestic jurisdictions, and the legal methods available for responding to new legal issues surrounding international family relations. As for public law theory, we examined how globalization is influencing public law paradigms. In administrative law, we examined "democratic legitimacy" in administrative process. In terms of criminal law, we examined how laws and regulations differ between each country based on culture and religion. As for commercial law, we examined orders that can substitute state orders. In relation to jurisprudence, we discussed how the balancing of interests is dominating legal thinking in a globalizing world.
