本研究の成果のうち特に重要なものを挙げると以下の通りである。第一に、性的画像記録の没収・消去に関する日本の現行法（2023年3月末時点）の問題点を指摘し、この問題に関する立法課題を提示することができた。第二に、アメリカの没収制度の全体像（民事没収、刑事没収、行政没収）および沿革を明らかにすることができた。第三に、オーストリアの没収制度の概要を明らかにすることができた。第四に、薬物犯罪、違法な高利貸しなどの財産犯罪、および金融商品取引法上の犯罪から得た財産の没収に関する裁判例を詳細に分析することにより、日本の没収制度の問題点を明らかにし、具体的な立法課題を提示することができた。
The following are the particularly important results of this study. First, we pointed out problems with Japan's current law (as of the end of May 2023) on confiscation and erasure of sexual image records and presented indicated a legislative agenda regarding this issue. Second, we clarified the overall picture (civil forfeiture, criminal forfeiture and administrative forfeiture) and history of the U.S. forfeiture system. Third, we described the overview of the Austrian confiscation regime. Fourth, through a detailed analysis of cases concerning confiscation of property obtained from drug crimes, property crimes such as illegal loan sharking, and crimes under the Financial Instruments and Exchange Act, we clarified the problems with the Japanese confiscation regime and indicated specific legislative issues.
