• 一般注記: 出版タイプ： VoR; type:text; 本研究は、執行府（行政府）内部において、法解釈等を行う主体がどのようにその任務を行い、また、裁判所や法学者による法解釈とどのような違いを有するかなどについて、比較憲法学の視点から検討するものである。 本年度は、日本における政府の憲法解釈に関連して、The 2022 International Review of Constitutional Reform (Luís Roberto Barroso ＆ Richard Albert, ed.)のJapanのChapterを共著で執筆した（Keigo Komamura, Mai Sugaya, Masayoshi Kokubo）。また、具体的テーマに関連して、死刑制度を題材に本研究に関連する次の論文を執筆した。Discussing the Constitutionality of the Death Penalty in Japan: Toward More Humane Methods of Execution, Journal of Japanese Law 28, 57-84(2023). 今後は、さらに研究を発展させて、より一般的に、Executive Lawyersに関する議論を行っていきたい。 This study examines how entities within the executive branch interpret laws and fulfill their duties and how their interpretations differ from those of courts and legal scholars from the perspective of comparative constitutional law. In the current year, in relation to constitutional interpretation by the Japanese government, I co-authored the Japan chapter of The 2022 International Review of Constitutional Reform (edited by Luís Roberto Barroso and Richard Albert) alongside Keigo Komamura, Mai Sugaya, and Masayoshi Kokubo. Additionally, I authored a related paper focusing on the death penalty system as a concrete theme of this research: "Discussing the Constitutionality of the Death Penalty in Japan: Toward More Humane Methods of Execution," Journal of Japanese Law, 28, 57-84 (2023). I plan to develop this research further and engage in broader discussions concerning "Executive Lawyers."
