判例の紹介 老齢年金の受給権者が死亡し,その相続人のあることが明らかでないとして,その相続財産が法人とされた場合において,受給権者の死亡当時,その死亡した者に支給すべき老齢年金でまだその者に支給しなかったものがあったとしても,当該老齢年金に係る未支給給付を受ける権利(支分権)は,受給権者の死亡により当該受給権者に帰属するものとしては消滅し,相続の対象にならず,当該相続財産に属さないものとされた事例[東京地方裁判所平成23.3.2判決]
