訓令・通達・回答(5348)日本人男と中国人女の婚姻が偽装であるとして検察官から刑事訴訟法第498条第2項による通知があり,日本人男及び中国人女の間の嫡出子として入籍していた子に関し,日本人男が認知の届出の効力を有する出生の届出をしていた場合において,原則として,「認知の届出の効力を有する出生届出」をした旨の記録をする必要はないとされた事例(平成24年12月21日付け2戸1第755号東京法務局長照会,平成25年1月7日付け法務省民一第9号東京法務局民事行政部長宛て民事局民事第一課長回答)
