最新判例批評([2014] 55)一 一六歳の少年が、風俗営業店(いわゆるキャバクラ)で大人びた態度で平然と飲酒遊興した場合であっても、民法二一条にいう「詐術を用いたとき」に当たらないとして、民法五条二項に基づく取消しが認められ、かつ、その一部については、健全な風俗を阻害するか、または、少年の思慮不足に乗じた暴利行為に該当するとし、未成年者と風俗営業店のキャバクラ接客契約それ自体が公序良俗に反し無効であるとされた事例[等][京都地裁平成25.5.23判決] (判例評論(第666号))
