刑事裁判例批評(389)大麻取締法違反保護事件において少年を第1種少年院に送致した決定に対する抗告に関し、少年が非行事実を争い、大麻の所持場面を現認したとする現行犯逮捕手続書の記載内容の信用性を争っていたにもかかわらず、警察官らの証人尋問を実施することなく非行事実を認定し、少年を少年院送致とした原審の審判手続は、必要な審理を尽くしておらず、決定に影響を及ぼす法令違反があると判断して、原決定を取り消して本件を原裁判所に差し戻した事例[東京高裁平成29.7.28決定]
