商事 A銀行が、県からの要請を受け、県において再建資金の融資を計画していたB社に対し、上記融資が実行されるまでのつなぎ融資をした後に、B社に追加融資をしてもその回収を容易に見込めない一方で、これをしなければB社が破綻、倒産する可能性が高く、上記つなぎ融資まで回収不能となるおそれがある状況の下で、B社に対して追加融資をした場合において、その追加融資の一部につき、これを決定したA銀行の取締役らに善管注意義務違反があるとされた事例[最高裁第二小法廷平成21.11.27判決] (最高裁判決速報 平成21年7月・10・11・12月言渡分)
