新判例解説(第371回)間接事実を総合して被告人を有罪と認定した第一審判決及びその事実認定を是認した原判決について,有罪の認定に当たっては,「直接証拠がないのであるから,情況証拠によって認められる間接事実中に被告人が犯人でないとしたならば合理的に説明することができない(あるいは,少なくとも説明が困難である)事実関係が含まれていることを要する」と判示した上で,審理不尽等を理由として各判決をいずれも破棄し,事件を第一審に差し戻した事例[最高裁平成22.4.27第三小法廷判決]
