最新判例批評([2010] 58)A銀行が、県から要請を受け、県において再建資金の融資を計画していたE社に対し、上記融資が実行されるまでのつなぎ融資をした後に、E社に追加融資をしてもその回収を容易に見込めない一方で、これをしなければE社が破綻、倒産する可能性が高く、上記つなぎ融資まで回収不能となるおそれがある状況の下で、E社に対して追加融資をした場合において、その追加融資の一部につき、これを決定したA銀行の取締役らに善管注意義務違反があるとされた事例(最二判平成21.11.27) (判例評論(第619号))
