判例紹介 間接事実を総合して現住建造物等放火,殺人等被告事件について被告人を有罪と認定した原判決について,被告人が本件放火殺人の実行行為を行った者,すなわち,本件放火殺人の犯人ではないとしたならば,合理的な説明が極めて困難である事実関係が存在する場合に当たるということができ,被告人が本件放火殺人の犯人であると優に認定できるなどとして,原判決を維持した事例[広島高裁第1部判決平成22.10.28]
