判例研究 被相続人である預金者が死亡し、その共同相続人の一人である被上告人が、被相続人が預金契約を締結していた信用金庫である上告人に対し、預金契約に基づき、被相続人名義の預金口座における取引経過の開示を求める事案の上告審で、共同相続人の一人は、共同相続人全員に帰属する預金契約上の地位に基づき、被相続人名義の預金口座についてその取引経過の開示を求める権利を単独で行使できるとした事例[最高裁平成21.1.22第一小法廷判決]
