民事法判例研究 数社を介在させて順次発注された工事の最終の受注者XとXに対する発注者Yとの間における、Yが請負代金の支払いを受けた後にXに対して請負代金を支払う旨の合意が、Xに対する請負代金の支払いにつき、Yが請負代金の支払いを受けることを停止条件とする旨を定めたものとはいえず、Yが上記支払いを受けた時点またはその見込みがなくなった時点で支払期限が到来する旨を定めたものと解された事例[最一判平成22.10.14]
