海上保安事件の研究(第57回)乗組員等が一人も生還していないことから,極めて人証と物証に乏しい事件で,船体構造と沈没の因果関係をどのように判断するかなど,海難原因の究明や過失の特定が非常に困難なケースであった,海洋調査船「へりおす」沈没(全損)事件について,船体の引き揚げに成功したことから,その全容がほぼ解明された事例(第一審,昭和63年仙審71号,仙台地方海難審判庁平成2年3月20日言渡,海難審判庁平成2年1・2・3月分裁決録1・2・3合併号。第二審,平成2年第二審9号,高等海難審判庁平成4年6月3日言渡,海難審判庁平成4年4・5・6月分裁決録4・5・6合併号696頁)
