有価証券等を担保に手形割引等を行うことを業とする会社が顧客との間で継続的小切手・手形割引取引契約を締結するに当たり,同人から譲渡担保として単位型証券投資信託(バランスユニット)受益証券の差入れを受けたことにつき,同人の所持の適法性に強い疑念があったにもかかわらず,必要な調査をしなかった重過失があるとして,右証券の善意取得が否定された事例(東京地裁判決平成7.6.6)
