判例研究下級審民訴事例研究(46)一訴えの提起において、提訴者が実体的権利の実現ないし紛争解決を真摯に目的とするのではなく、相手方当事者を被告の立場に立たせ、それにより訴訟上又は訴訟外において有形、無形の不利益・負担を与えるなど不当な目的を有し、提訴者の主張する権利又は法律関係が事実的、法律的根拠を欠き権利保護の必要性が乏しいなど、民事訴訟制度の趣旨・目的に照らして著しく相当性を欠き、信義に反すると認められる場合は、訴権を濫用するものとして、訴えを却下すべきである二訴えの提起が訴権の濫用とされた事例(東京地裁平成12.5.30判決)
