第三者名義に保存登記のある不動産を代物弁済として取得したが未だ移転登記をしていない者は,登記がないから,売主の債権者で,売主の右の第三者に対する移転登記請求権を代位行使し,これを仮差押した者に対抗できない。売主の登記請求権は未だ消滅していなかったら、これについての代位登記も仮差押登記も有効である
