医療過誤 重要裁判例紹介(第77回)不妊治療中の患者の子宮筋腫核出術を行った際ガーゼを残置したため患者に卵巣嚢腫が発生し子宮外癒着及び卵管閉塞が生じた場合、これに気付かないまま3年間にわたり人工授精及び体外受精を多数回施行したことに対し、病院側にガーゼ摘出の費用のほか無益な人工授精等に要した費用及びこれに伴う慰謝料の損害賠償責任が肯定された事例[東京地方裁判所平成18.9.20判決]
