Note (General): 相続人のあることが明らかでない場合に選任される相続財産管理人に関する審判の新受件数は、昭和₄₀年の₉₁₀件から令和 ₂ 年には₂₃,₆₁₇件に増加しており、相続人不存在の事例が年々増加していることが統計上からも推測される。このような相続人不存在の事例が増えるにつれ、特別縁故者制度についても少なからず脚光を浴びることとなっている。特別縁故者制度は、昭和₃₇年（₁₉₆₂年）の民法の一部改正によって導入されたものであり、制度導入後昭和₄₀年の特別縁故者への相続財産の分与に関する審判の新受件数は₁₈₉件に過ぎなかったのに対して、令和 ₂ 年には₁,₁₁₃件に上っている。本誌においても特別縁故者に関する裁判例は過去に複数回取り上げられてきている。今回取り上げた事件は、いずれも親族から申し立てられた事案である。
