本研究では、図書館利用記録の秘密性について成り立ちから検討を行い、国家権力に対する抵抗の理念が強く見られることを見いだした。さらに利用記録の秘密性は単に個人を保護するのみならず社会制度をも保護しているといえることを把握した。これらの保護は、プライバシーを財産権ととらえる法哲学上の学説と強い関連を有する。プライバシーの権利を人格権ととらえるか財産権ととらえるかは、現在法哲学のひとつの課題となっている。図書館利用記録もまた、必然的にこの枠組みのなかで検討する必要があることがわかった。
In this study, Iexamined the origins of confidentiality of library records, and found that, the origins were strongly related to the resistance to state power. Confidentiality of library records protects not only indivitual, but also society as a whole. The protection of confidentiality strongly relates to the theory of the philosophy of law, that treat privacy as a property rights. Now it is a matter of the philosophy of law that whether privacy right is a human right or a property right. The subject of confidentiality of library records must be examined with this framework of philosophy of law.
