近隣関係の変容する様子をみて気付くのは、近隣紛争がうまく解決されずに深刻な事態になる事例が次第に増加していることである。ピアノ、ステレオ、クーラーなどの生活騒音をめぐる紛争、ペットをめぐる紛争、日照権をあぐる紛争などはよくみられる例である。第二講では、そのような深刻な近隣紛争事例のなかから、いわゆる「隣人訴訟」とよばれる具体的な事例をとりあげて検討してみよう。これは、親が買物に行く際に「預けた」子供が近くの溜池で水死した事件の責任をめぐる訴訟事例である。
