本研究は、アメリカ合衆国におけるコンスピラシー(criminal conspiracy)の概念・訴追・解釈について紹介し、検討を加えようとしたものである。もっとも、近年は、アメリカ法に言及する研究も少なくなく、アメリカ刑法一般についていえば、既に、定評のある教科書の邦訳も刊行されている。また、コンスピラシーについても、特に近年は共謀罪創設をめぐる動きの中で多くの論稿が公表されている。そこで、本研究では、これらの先行業績との重複は避け、コンスピラシーが検察官にとって「最愛の人」であるといわれる理由を確認した上で、「愛される理由」のひとつであると思われる、ピンカートン・ルールについて検討した。
