「法益」概念は、現代社会における経済事犯の不法実体を捕捉し、解釈論を先導する観念として、適用場面を適切に限定すればなお中核的な役割を果たし得るが、その実効的な保護を考える上では、組織体「文化」ないし「風土」というような規範論的実体概念を適切に用いる必要がある。しかし、我が国の経済刑法学説・実務等は、法益概念の内実及び法益保護思想の理解において大きな問題を抱え、規範論的実体概念の受容も不活発である。
