古典文献のディジタル化・データベース化の前提作業とも言える「本文の確定」、その基礎を構成する文献学、そしてその具体的実践としての「校訂」、これらはいずれも、わが国において法的議論の対象となることがほとんどなかったものである。だが、近時、情報通信技術の革新に伴い、「校訂」の成果たる学術情報の汎用性がおおいに拡大し、当事者を含め関係者の間に見られる利害状況も一変した。本稿では、まず「校訂」が古典の文献学的研究においてどう意義づけられているのかを明らかにし、一旦「校訂」を最広義に捉えつつ、われわれが通常「校訂」と呼んできたいくつかの用例に触れ、「校訂」の実務上あるいは判例上の取扱いを含め、その諸相を素描する。その上で、「校訂」がいかなる幅を有する概念なのか、あるいは、それと隣接する概念にはいかなるものがあるのかを整理・検討することを目的としている。本稿では、その結論として、「校訂」に創作性・独自性を認める余地が存在し、著作権法上の保護の可能性を示すとともに、もう一つの可能的選択として隣接権的構成による保護を視野に入れた対応も示唆する。
