本稿では、情報通信分野における民営化と競争導入を画することになった電気通信事業法下において、「接続」や「卸」をはじめとする一般利用者に電気通信役務を提供するための事業者間取引の態様やそれらの法制度上の取扱いを、古く公衆電気通信法からひも解き、その展開を辿っている。そして、これらの取引態様、殊に「接続」の法的性格とかかる構成を採ることに由来する帰結について検討し、これを踏まえ、近時課題として浮上してきたローミング問題での「接続」・「卸」の相対化の下における便宜的な対応に対し懸念を示すと同時に、いわゆる機能分離の議論においても「接続」・「卸」間の規制の違いに由来する同様の問題があることを指摘する。
