本研究では、同性婚や、生殖補助医療により生まれた子の親子関係など、最近の各国において導入されてきている新たな身分法制への対応が国際私法方法論に及ぼすインパクトについて検討した。その結果、国際私法の伝統的な双方主義的方法論がそれらの法制度を規律するのに最適な方法であるとは言い切れず、国際私法方法論自体の再検討が求められていることが明らかとなる。この点、EU法において最近拡大傾向にある、いわゆる相互承認原則が国際私法の分野に及ぼしつつある影響も看過しえない。法廷地国は、双方主義的な抵触規則、あるいは、外国判決承認ルールを通じて、渉外的法律関係を規律し尽くそうとしているが、新たな身分法制についての国際私法側の対応としては、たとえばEU法の相互承認原則のような従来とは異なる例外的な救済方法を用いる可能性についても、今後議論してゆく必要があろう。
