本研究では, ①法廷において提示すべき事実・証拠の選別と②それらを事実認定者に提示する技術の総体であるアドヴォカシーの法的規律について, 主に①の点に着目して分析検討を加えた。その結果, 「解明度」という概念とそれを規定する諸要素(訴訟の目的や構造に起因する制約と, 事実認定者や一般国民の事実解明への欲求)の明確化が重要な手掛かりになるとの見通しを得ることができた。
