EUや欧州人権条約により形成されているヨーロッパ法とそれに呼応しつつも部分的には抵抗している各国法秩序の両者全体を, 一元的な最終権威(ないし「承認のルール」)で階層的かつ調和的に捉える思考をするのが「憲法」「立憲主義」的な方法論である。各国の憲法でなじみ深い「立憲主義」の方法論に関心が向けられがちであるがそれは現代のヨーロッパのマクロ法現象をみる目としては予断を含んだ見方に過ぎない。そのような方法論で捉えることが, 事実認識の方法として, またあるべき法秩序像を示すための規範論として果たして妥当なのかどうか, それこそが問題である, と考えられる。
