法廷においては、居合わせた人に強い感情を引き起こすようなやり取りが多くなされる。裁判員が判断を下す際に、感情の影響を受けてゆがんだ判断をしてしまうことがないか、それを防ぐような手だてはないかについて、模擬裁判員実験を行って検討した。その結果、模擬裁判員のある種の感情(怒り、同情など)が被告人の有罪無罪の判断と関係していることから、感情により裁判員の判断が影響を受ける可能性が指摘された。さらに、判断の仕方についての説明を加える、判断するまでに時間を置くなどにより、感情の影響を抑えられる可能性があることも示された。 In courtrooms, lay judges are exposed to a lot of inflammatory information. information. We examined if lay judges are influenced by their emotion and make biased decisions, and sought means to prevent such influences with mock lay-judge experiments. Results show that lay judges' emotions such as anger and sympathy correlates with guiltiness judgment. The possibility that lay judges' decisions are influenced by their emotions is shown. It is also shown that we could suppress the effects of emotion by the means like instruction on judicial procedures and/or principle of decision making in the courtroom and having the delay between the trials and decision.
