本研究は, 行政機関(例えば税務職員, 公正取引委員会の行政調査部門)が行政目的(例えば, 租税の賦課徴収, 課徴金賦課や排除措置命令)達成のために取得収集した情報・資料を, 刑事手続(犯則調査を含む)において利用すること(有罪立証のための証拠としての利用に限らず, 捜査の端緒としての利用も含む)について, 我が国におけるこれまでの議論の集積の上に立って, 行政手続と刑事手続における手続規制の相違や刑事手続上の基本権との関係のみならず, 法の実現における行政手続と刑事手続の役割分担にまで視野を広げながら, その可否及び限界, 規整原理を明らかにする(提示する)ものである。 This research explores if, how, and to what extent information obtained by administrative agencies for non-criminal purposes can be shared with or transferred to the police and the prosecution and be used in simultaneous or successive criminal proceedings.
