NTT東西を相手取り, ソフトバンク株式会社が訴えた独占禁止法24条にもとづく差止請求は, 東京地方裁判所によって棄却され, 2014年7月に確定した。この事件に至るまでの経緯と裁判所の判断を通じて見えてきたものは, 競争を促進するはずの接続規制が, ときに被規制者の市場支配力を維持・強化させることがあり, そのような場合に独占禁止法を適用してこれを是正させることは, 日本では極めて困難だということである。本稿は, 上記のような状況を作りだした原因が, 以下の4点にあることを指摘する。まず第一に, 接続規制の本来の目的と個々の規定の現実の効果との間にギャップがあること。第二に, 規制当局への配慮を優先する独占禁止法の適用が行われてきたこと(たとえば, NTT東日本私的独占事件)。第三に, 条文の形式的な解釈が司法解決の可能性を狭めていること(たとえば, 8分岐訴訟)。第四に, 規制に内在するリスクが考慮されず, 規制の上書きだけが繰り返されていることである。本稿では, これらの点の分析を通じ, 接続規制に内在する問題を指摘するとともに, 規制された市場における独占禁止法適用の問題を提起する。これらの問題は, 過去のものと認識されつつある固定通信分野の接続に限ったことではない。移動体通信分野や電力分野における接続はもちろん, ビッグデータが話題となる昨今においては, そう遠くないうちにデータへのアクセスという問題が生じる可能性がある。 Injunction against NTT East and West, in accordance with Article 24 of the Antimonopoly Act sued by SOFTBANK CORP., was rejected by the Tokyo District Court and finalized in July 2014. Through this case, we can find that the connection regulation inhibited which should promote competition makes a market power of regulated undertakings. In such case, it is very difficult to apply the Antimonopoly Law and make it correct this in Japan. We will ask the following point for which made such situation and raise the problem of inhering in connection inhibited and a problem of the Antimonopoly Law application in a regulated market : First, estrangement is between the gist of the connection regulation inhibited and the real effect of the law. Second, a competition authority gives priority to consideration to a regulation authority and has applied the Antimonopoly Law. Third, after a courthouse interpreted a text of law formally, a possibility of the judicial solution in the regulation field is being narrowed. Fourth, the risk which inheres in the regulation is not considered, and the regulation is overwritten repeatedly.
