2014年4月から「法制審議会・国際裁判管轄法制(人事訴訟事件及び家事事件関係)部会」において, 国際的な身分関係事件の国際裁判管轄に関する明文規定の整備について詳細な検討が行われ, 2015年10月9日の法制審議会総会(第175回)において, 「人事訴訟事件及び家事事件の国際裁判管轄法制の整備に関する要綱」が採択され, 法務大臣への答申が決定された。これを受けて作成されたのが, 「人事訴訟法等の一部を改正する法律案」である。本法案は, 2016年2月26日, 第190回国会に提出されたが, 2017年の国会では審議未了であり, 現在(2018年3月26日現在)も国会で審議中である。そのため, 新法の国会通過に合わせての論文の公表が延期となってしまった。本研究では, 国境を越えて生じる相続関係事件の国際裁判管轄に関する問題に焦点を当て, 新法の詳細な分析を継続中である。具体的には, 新法の単なる紹介の域を超えた分析･検討をし, 新法の内容と従来の日本の判例・学説との関係や, 新法の個々の規定の立法趣旨を踏まえた上で, それらの規定についての批判的な分析, 新法の内容の理論的な評価といった点にまで踏み込んで検討を行っている。 This study on International Jurisdiction over an action relating to a Succession analyzed the new draft of the provisions on international jurisdiction concerning personal status litigation cases.
