本研究は、「政府」ないし「執行府」の憲法解釈に注目が集まっている近年の日本の状況下において、それを統制するためにはどのような方法があり得るかについて、とりわけ「議会」の役割に注目して検討したものである。本研究により、議院内閣制を採る日本において、議会による政府の憲法解釈統制は主として政府の立場を明確にさせ、その整合性を問うという形で機能すること、議会もまた法律制定の際に憲法解釈を行っているのであり、内閣提出法案の場合は政治部門の憲法解釈という形を取るということに注意が必要であることなどを明らかにした。 This research is a study of governmental interpretations of the constitution and the function of the legislature to control these interpretations. I explain or consider that the role of the legislature in parliamentary cabinet system is mainly let the government make clear their interpretation and ask the consistency of it, and legislature also make their own interpretations of the constitution when they enacted laws.
