研究は、①デジタルトランスフォーメーション（DX）によって新しいビジネスを創出し、かつ、競争力を維持する上で、知的財産法制（特許法・著作法・不正競争防止法など）にどのような課題があるかを考察すること、および、②DX によって企業における法務業務（企業内法務業務）がどのように変化し、それが企業経営にどのような影響を与えるかについて検討すること、の2点から構成される。本年度は、①については、計画通り、改正著作権法および改正不正競争防止法の分析・検討を中心に行った。その成果は、法律雑誌主催の改正著作権法に関する座談会での発言にあたって、また、「限定提供データに関する指針」の素案を策定する経済産業省のWGで委員としての務めを果たす上で活用した。さらに、改正著作権法に関する研究内容は、5月に予定される企業内法務担当者向けセミナーで報告することになっている。 ②については、企業内法務関係者からのヒアリングや意見交換を行い現状の把握を行うとともに、それらを踏まえて、法務部門の望ましい戦略についての検討も行った。その成果の一部は、法律雑誌主催の、令和時代の企業内法務の在り方を論じる座談会の企画・発言などに活用された。 ①②ともに、計画を踏まえた進捗であると考えている。 First, I focused on the analysis of both the Revised Copyright Act and the Revised Unfair Competition Prevention Act. The analysis was a base for most of my remarks at a roundtable discussion on the Revised Copyright Act the record of which will be published in a legal periodical soon. In addition, I will speak on the analysis of the Revised Copyright Act at a seminar for in-house legal staff in May. Also, the results of the analysis of the Revised Unfair Competition Prevention Act were helpful to me, a member of the working group of METI which drafted the "Guidelines on Limited Provision Data protected by the Revised Unfair Competition Prevention Act." Next, I had an exchange of views with in-house legal staff of several companies on the current issues which a corporate legal affairs division faced and, based on that, made a study of the desired strategy of corporate legal affairs divisions. Some of the study results were used for planning and remarks of another roundtable discussion on the required functions of corporate legal affairs divisions in the Reiwa era. The record of the discussion will be published around August.
