• Note (General): 出版タイプ： VoR; type:text; 2018年6月6日に、ドイツ連邦共和国ザールラント大学法学でのシンポジウム（統一テーマRechtsprobleme der Risikogesellschaft）で、「東日本大震災における賠償責任とADR」と題する講演を行った（報告はドイツ語による）。 本報告では、Ⅰ問題提起として、東日本大震災事故について3つの特徴を指摘した。第1に被害地域が広範囲であること、第2に放射性物質による被害が長期間に及ぶこと、第3に上記の特徴に伴い被害者の生活が根本的に変更を余儀なくされることである。これらの特徴を有する被害の賠償を手続的側面から検討することが報告の目的である。つぎに、Ⅱ原子力損害賠償制度の実体的な規律を検討した。原子力損害賠償に関する各種の条約（1960年パリ条約、1963年ウィーン条約、1977年CSC条約）のうち、2015年にCSC条約が日本で発効している。国内法としては、原子力損害賠償法がある。東日本大震災における福島原発事故に際しては、東京電力（TEPCO）の民事責任は肯定されると考えられる。そこで、Ⅲどのようにして原発紛争を手続的に処理するのかが問題となる。被害者が東京電力（TEPCO）に対して賠償を求める方法として、①裁判外での直接請求、②民事訴訟、そして③原子力賠償ADRが考えられる。③について、2018年3月時点で累計申立件数が23,215件、累計既済件数が21,399件、和解成立が17,548件であり約75％が和解で終結している。終結までに要する期間は平均6か月である。Ⅳこのような紛争処理の状況をどのように評価するのかであるが、つぎの点を指摘することができる。生活基盤を失った被害者に、いかにして迅速な紛争解決を提供するのかが大きな課題となる。この点について、個別的な紛争をある程度捨象して統一的な損害賠償基準が策定・公表されている（総括規準）。これによって共通する部分について個別事案間の公平性が確保される。また、弁護士による調査官制度が導入され、被害者と加害者の交渉力の格差を是正する試みがなされている。約75％が和解で終結しているということは、ある程度被害者にも、このようなADR制度が受け入れられていると評価できる。今後の課題としては、事故後相当時間が経過したにもかかわらず解決しない難事件をいかにして処理するのか、ADR手続における東京電力（TEPCO）の対応が適切であったのか、あるいは総括規準による処理の検証が必要であろう。 The lecture titled "Compensation Liability and ADR in the Great East Japan Earthquake" was given on June 6, 2018 at the symposium (general theme "Rechtsprobleme der Risikogesellschaft") held at Saarland University, Faculty of Law in Federal Republic of Germany (this lecture was delivered in German language). In this report, I) to raise the issue, I pointed out the three characteristics about the nuclear accident inflicted by the Great East Japan Earthquake. First, quake-hit regions are quite extensive. Second, contamination caused by radioactive materials will last very long time. Third, due to the above characteristics, disaster victims are forced to change their life radically. The purpose here is to discuss the issue of compensation for damage which bear the above characteristics, from a perspective of civil procedure. Next, II) I reviewed the subjective rules of the compensation program for nuclear accident. Among the several conventions related to compensation for nuclear damage (1960 Paris Convention, 1963 Vienna Convention, 1977 CSC), CSC (Convention on Supplementary Compensation for Nuclear Damage) came into effect in 2015 in Japan. As a domestic law, we have Act on Compensation for Nuclear Damage in Japan. As for the Fukushima nuclear accident in the Great East Japan Earthquake, civil liability of TEPCO will be confirmed. Then, III) the question is how the dispute regarding the nuclear accident should be treated in terms of civil procedure. There could be three approaches to seek compensation by disaster victims against TEPCO: 1) out-of- court direct petition, 2) civil suit, or 3) nuclear accident compensation via ADR. Regarding 3), as of March 2018, there have been total 22,215 cases claimed, 21,399 cases treated, and 17,548 case (about 75%) reached settlements. The average period to reach a conclusion is 6 months. IV) To evaluate the situation of the dispute handlings, following points can be pointed out. The important challenge is finding the way to provide the rapid dispute solution to disaster victims who lost their home and stable life. To achieve this, by exteriorizing the individual disputes on some level, the unified standard (general overviewed standard) for damage compensation has been developed and publicly disclosed. By following this standard, equitability for common issues in individual cases shall be ensured. Also, the inspector system by lawyers has been introduced as a commitment to fill the negotiating power gap between victim and victimizer. Since about 75% of petitioners has come to settlement, it is considered that these ADR systems had been accepted by victims in some extent. For the future tasks, we need to determine how to treat the difficult problems which has not been resolved even so long time had passed after the nuclear accident, and we need to verify if the handlings of TEPCO or handlings according to the general overviewed standard have been proper or not.
