• Note (General): type:text; 特にプロファイリングと個人信用スコアの規範的評価に関する研究を進め、ともに社会全体の効率化と個人責任原則の貫徹という観点からは積極的に評価することができる一方、導かれた結果の適切性をめぐる問題が生じ得ることを指摘した。その際、複数の主体が競争的にサービスを展開する場合には市場競争を通じて問題状況が是正されることが期待できることから、民間事業者の非独占的なサービスにおいては合理性によっては是正できない問題（いわゆる合理的な差別）に限定して中立性の証明など一定の公的規制が正当化されること、サービスの複数性・移動可能性を保障するために自然独占を含めて禁止する競争法的な規制が必要となることを主張し、特定の行為類型を禁止する業法的規制に反対した。また、現在の中国で構想されているような社会信用システム、すなわち民間事業者が展開する個人信用スコアを統合・一元化して治安管理に活用するような構想については、国家が離脱不能かつ唯一なサービス提供者であることから市場競争を通じた是正を期待することができず、人権に基づく適用範囲の抑制や情報公開・異議申立てなどより厳格な手続的規制が必要であると指摘し、そのような規制が期待できない場合には正当化できないと結論づけた。研究成果については複数の論文として刊行（予定も含む）されているほか、総務省情報通信政策研究所、国際高等研究所、大阪大学などが主催する研究会・シンポジウムにおいて複数回の報告を行なっている。 Through normative evaluation on especially profiling and personal credit score system, while they can be positively evaluated on the viewpoint of social efficiency and perfection of personal responsibility, the researcher pointed out the appropriateness of their result will be highly problematic. To this issue, the researcher opposed to the administrative regulations to prohibit certain type of action, as in the case plural civil business competing to provide their services we can estimate that the inappropriate result will be fixed through market competition, and supported certain extent of regulation to secure neutrality in the problems market cannot fix (eg. reasonable discrimination), and from the viewpoint of competitive law. The researcher also concluded that the social credit system now in consideration in Chinese government to unify and integrate civil businesses to provide personal credit score to utilize in national security matters cannot be justified unless highly strict control based on human rights and procedural burden to force information disclosure and objection, because the government is the sole, noncompetitive, and inwithdrowable provider of such service. The achievement was (to be) published in some papers, and reported in several committees and symposiums held in the Ministry of Home Affairs and Telecommunications, International Institute for Advanced Studies, and Osaka University.
