欧州連合（EU）の加盟国がEUから離脱する手続きは、EU条約第５０条に定められている。本研究では、その手続きを踏まえて、実際のイギリスのEU離脱(Brexit)交渉プロセスを調査し、交渉結果である離脱協定（北アイルランド議定書を含む）と英EU将来関係政治宣言の分析を行うとともにEU法秩序への影響について検討した。離脱協定は、イギリスの秩序あるEU離脱を確保することを目的とする。その交渉の中で最後まで紛糾したのが北アイルランド国境問題のバックストップ（安全策）であった。それは、北アイルランド国境問題が英EU将来関係協定で永続的に解決できない場合の一時的な安全策を提供するための取り決めである。具体的には、約２年間の移行期間（さらに２年間まで延長可能）に英EU将来関係協定で解決策に合意できない場合に、イギリス全体がEUとの関税同盟に一時的にとどまることにより、北アイルランド国境での税関検査を不要にすることが主な内容である。しかし、英保守党内の強硬離脱派や、メイ政権を閣外協力で支える北アイルランド地域政党の民主統一党（DUP）は、そのような関税同盟が永続化するリスクがあることなどを理由として、バックストップに反対している。そのため、メイ首相の要請でEU側がバックストップの暫定性格を追加的に保障したにもかかわらず、イギリス議会で承認が得られないままになっている。 EUの単一市場は、物・人・サービス・資本の自由移動を一体として実現するものであり、EU法秩序の要である。EUは単一市場の一体性を一部犠牲にしてもイギリスにバックストップとして関税同盟を提供した。北アイルランド国境問題の永続的解決のためには、何らかの形でイギリスがEUの単一市場と関税同盟にとどまる仕組みが必要である。このように、円滑なBrexitを困難にしている北アイルランド国境問題が、イギリスのEU残留を何らかの形で不可欠とする「Brexitパラドクス」が生じている。 The United Kingdom (UK) and the European Union (EU) have agreed on the Withdrawal Agreement (WA) and the Political Declaration on the UK/EU future Relationship. The backstop included in the Protocol on Northern Ireland of WA provides for a provisional UK/EU Customs Union to avoid a hard border between Northern Ireland and Ireland. This is strongly criticised by Brexiters within the UK Parliament, because they fear that such a Customs Union could be permanent even after UK withdraws from EU. This is why the UK Parliament has refused to endorse WA, and there are lots of uncertainties around Brexit. But we can see the phenomenon of a "Brexit paradox" in this context. This because the problem of Northern Ireland border, which makes Brexit very difficult, connects UK with EU, since UK must continue to participate in the Single Market and the Customs Union of EU in some form at least.
