• Note (General): type:text; 本研究は、昨年度に引き続き、経済秩序と国家との関係を根本的に問い直し、新たな法理論を構想することを目的としていた。昨年度はその大部分を未達成のままにしていたが、本年度においては非常に進展したと考えている。 具体的な成果は以下の通りである。 まず、現象学的存在論の観点から国家の存在論的分析を加えることができた。それによって、従来の法学において＜人格的存在者（法人）＞として人格と不可分に捉えられていた国家について＜人格＞と＜個体的存在＞に分けることができた。本年度はこの分析と後者についての存在論的分析に傾注したため、人格の存在論については比較的手薄であったことは否めない。しかしながら、従来ともすれば団体の人格と構成員の人格との同時存在という背理を受け入れてしまっていた憲法学において人格と個体的存在を分けて論じる道を示したこと自体が一定の成果であると考える。 またかかる分析手法からHauriou制度論も再構成する道を示し、従来「霧中」と評されてきた彼の制度論について多少なりとも明晰な構想を析出できたと考えている。そして彼の「国民主権」論文の読解において、先の現象学的存在論や芸術作品制作論を援用し、「主観（l'état）／客観（l'institution nationale）」と両者を架橋する「国家＝一般意思」との関係を、歪像と反転図形が併存する絵画になぞらえて論じたことは、今後の理論構想の精緻化においてメルロ＝ポンティの制度化理論を援用する可能性を拓いたと考えている。 もっとも、このような形而上学的検討だけでなく法学的検討も行わなければならない。この点の精緻化は来年度に回さなければならなかったが、その一つの可能性として、「弊害」という要素に着目して日本における職業の自由に関する判例法理の再構成を行った。それによって構想の有用性と法理論としての可能性を示した。 以上はまだ試論であり、今後の精緻化が求められる。 In my research, I intended to (re)construct a new theory of law about the relationship between the economic order and the state. I have had the similar intention at the last academic year, but, I think, the progression have occurred this year. First of all, I analyze the state by the phenomenological ontological way. Then I distinguish the individuality of the state from its personality, although constitutional scholars have seen the state as "personal-individual" thing. I should confess that I have not sufficiently analyzed the ontology of the personality of the state. But the distinction itself is a good fruit of my research, because constitutional scholar usually miss the distinction. Secondary, I explain the M. Hauriou's theory of Institution more clearly. And I indicate the way to explain the Hauriou's theory by using the Maurice Merleau-Ponty's theory of institutionalization. Because, I read the Hauriou's paper, "the national sovereignty", by the the phenomenological ontological way and the theory of art. However, I must construct the the legal theory. I will do it at the next academic year, but I have indicated it by reconstructing the case law of Japan about the freedom of occupation. These researches are not completed, so I will refine them.
