• Note (General): type:text; 2018年6月5日、6日にかけてザールラント大学において開催された日独法学学術シンポジウム（統一テーマは、「危険社会における法的諸問題」。日本からは、慶應義塾大学、中央大学、関西大学から合計8名が報告者として参加）において、「日本刑法における処罰時期の早期化について」というテーマで、ドイツ語による報告を行った。 同報告では、日本刑法の成立当初から存在する陰謀・予備の処罰規定について、原則として単独犯による予備行為を処罰しないドイツ刑法典と対比する形で紹介し、また、最近20年の間に行われた処罰の早期化に係る刑法改正について解説した。最後に、2017年の組織的犯罪処罰法の改正により導入されたテロ等準備罪について、2003年に国会に提出された当初の共謀罪法案と比較して論じた。 これまで、ドイツ語で日本のテロ等準備罪について紹介した文献はなかったことから、ドイツ人参加者からは、同罪の要件の厳格さ、複雑さについて驚きの声が上がった。当初の予想通り、いわゆる「共謀罪問題」に関する日独の温度差を確認することができた。同報告の内容は、上記シンポジウムの講演録の一部として、2019年度中にドイツの出版社（Verlag Alma Mater）により刊行予定である（2019年4月5日時点で、著者校正済）。 2018年秋からは、ドイツ刑法典30条の重罪の教唆の未遂、重罪遂行の準備表明、重罪遂行の申出の受け入れ、重罪の共謀のそれぞれの要件についての判例・学説の調査を行った。しかしながら、この時期から、学内業務が多忙化し、また、犯罪収益のはく奪制度の比較研究をはじめとする他の複数の調査・研究課題に取り組む必要が生じたため、本研究課題に対するエフォート率が極度に低下し、公刊には至っていない。犯罪結社罪の研究も含め、できるだけ早い時期に研究成果を公刊することを目指したい。 I made a report in German on the theme ,,Making the Stage of Punishment Earlier in Japanese Criminal Law'' at Japan-Germany Academic Symposium of Law on June 5th and 6th, 2018 at Saarland University (,,which was held under the general theme, Legal Issues in the Risk Society''. 8 Japanese reporters were the participants from among Keio University, Chuo University and Kansai University.). My report introduced the provisions of punishing plots and preparations existed since the establishment of the Japanese Penal Code by contrasting with the German Criminal Code which in principle doesn't punish preparatory acts done by single person. In addition, I explained the reforms made to the Japanese Penal Code in the last 20 years, relating to making the stage of punishment earlier. At the end, by comparing with the conspiracy bill submitted to the Diet in 2003, I gave a consideration on the offence of planning to commit a serious crime that entails an act of preparation by a terrorism group and other organized criminal groups which had been newly introduced by the Amended Act on Punishment of Organized Crimes and Control of Crime Proceeds enacted in 2017. Since there were no works explaining the offence in German at that time, German participants were surprised at the severe and complex requirements of the offence. As expected, the difference of perception between Japan and Germany over punishing conspiracy came to light. The content of my report is to be published from Verlag Alma Mater, a publishing company, as part of the proceedings of the symposium (proofread as of April 5th, 2019). Since the fall of 2018, I have made a research on the cases and theories of the requirements of the section 30 of the German Criminal Code, which punishes attempting to induce another to commit a felony, declaring his willingness to commit a felony, accepting the offer of another to commit a felony and agreeing with another to commit a felony. However, occupied with the on-campus duties and other researches including a comparative research on depriving proceeds of crime, the progress of this research task became unfavorable, which has led the results of the research not published yet. Publishing the results of the research as soon as possible, including a study on the offence of forming criminal organizations, is what I aim.
