• Note (General): type:text; 本研究は，民法整備への国際協力を通じ，一般市民の権利を保護して労働へのインセンティブを高めることにより，より多くの市民が民法整備の成果を享受することができるインクルーシブな制度改革の方法を，ベトナム，ラオスおよびカンボジアへの民法整備支援を題材にして，開発法学の視点から探求するものである。 ラオスは，1986 年のチンタナカーン・マイ（新思考）政策策定後，外国投資を受け入れつつ，国内取引を活性化するために，1990 年以降民法関連法令を制定してきたが，包括的な民法典の制定に向けて，段階的に準備を始めた。民法整備支援もその中で始まった。それは外国民法典を移植するのでははく，現行法実務を踏まえ，民法の知識を蓄え，起草能力を高めることからスタートした。そのための法律辞書，民法教科書，民法基本問題集等の作成に対する支援が2002年から2012年まで続いた（第1段階）。この準備作業をベースに，2012年から民法典の起草が始まり，2015年草案の作成とラオス各地でのパブリック・ヒアリング，国会議員への説明と草案修正を繰り返し，2018年12月，ラオス初の民法典が国会を通過した（第2段階）。それは総則・人・家族・財産・契約・契約外債務・担保・相続からなり，ラオスの伝統と現行法をベースに，国際動向を反映した点に特色がある。国会通過後，国民への普及活動が始まり，逐条解説書の作成が進んでいる（第3段階）。それは，各条文の目的・具体例・民法典と現行法の違い・新条文や改正の理由，外国民法典の状況，裁判例等の情報を盛り込むものである。 ラオス民法整備支援の特徴は，①徹底したプロセス重視の協力，②司法省・裁判所・検察院・大学といった広範囲の受入側機関の協力による推進にある。このことは，今後の普及活動，法学教育分野での国際協力への接点を提供する。今後は，裁判例の公開や批評に向けての準備が重要になると考えられる。 This study aims to investigate the method of inclusive institutional reform which can bring its benefits not only to the privileged professionals but also the general public by promoting the protection of the people's rights through the international cooperation for civil law reform. It is based on the comparative analysis of civil law assistance for Vietnam, Laos and Cambodia from the viewpoint of Law and Development. The government of Lao P.D.R launched the policy of New Thinking in 1986 and implemented it by enacting individual laws and regulations relating to civil law so as to attract foreign investments and promote economic transactions since 1990s. The comprehensive Civil Code Project started in the end of 1990s by preparing the legal lexicon, civil law textbooks, civil law casebooks, etc. which lasted until 2012 (Step 1). On the basis of this preparatory stage, Civil Code Project officially launched in 2012. The 2015 Draft was submitted for public consultations in various regions in Laos, explained before the members of National Assembly, and revised over and over again. It passed the National Assembly in December 2018 (Step 2). After that clause by clause comments which will include the purpose of each provision, examples, difference from the existing law, the reason for new provision or revision, comparative civil law, precedents, etc. are now prepared to facilitate dissemination activities (Step 3). Features of civil law assistance for Laos are (1) the thorough process oriented cooperation, (2) the step by step (incremental) promotion of cooperation activities, and (3) the wide range of cooperation among counterparts including Ministry of Justice, Courts, Prosecutors Office and University. They are the advantages for the promotion of dissemination through legal education and publication of precedents concerning civil law.
