• Note (General): type:text; EUの単一市場とは、物･人･サービス･資本の自由移動を意味する。単一市場が機能するのを確保するため、EU司法裁判所は、EU基本条約の「解釈及び適用において法の尊重を確保する」ことを任務とする（TEU19(1)）。2020年1月31日、イギリスは離脱協定 に基づきEUから離脱した。イギリスのEU離脱は、法的にはイギリスがEU法秩序から切り離されることを意味する。それは、実体法的にはEUの単一市場および関税同盟に関するルールがもはやイギリスには適用されなくなるということである。しかし、北アイルランドの和平プロセスを維持し、紛争再発を防ぐためには、ブレグジット後もアイルランドと北アイルランドで人と物の自由移動を確保して、ハードな国境を回避することが求められた。人の自由移動はイギリスとアイルランドの間の「共通往来地域」により維持される。しかし、物の自由移動のためには、少なくとも北アイルランドをEUの単一市場（物の自由移動）と関税同盟にとどめる必要が生じる。しかしそれでは、イギリスがEUを離脱した後にも、北アイルランドがEU法とEU司法裁判所の管轄の下に置かれることを意味する。 イギリスのEU離脱を実現するという点では同じでありながら、メイ前首相は経済的合理性を追求する一方、ジョンソン首相は政治的合理性を最優先した。メイ前首相は、EUの単一市場と関税同盟からの離脱を追求しつつも、イギリスがEU法との整合性を保ちつつ緊密な貿易関係を維持することにより、Brexitの経済的悪影響をできる限り回避しようとした。これに対し、ジョンソン首相は国家主権の「回復」を主張して、EU法秩序からの訣別を追求し、その限りで経済的不利益を甘受するという立場をとった。しかし北アイルランド問題の解決のため、北アイルランドを事実上EU法の下に残留させ、英本土から切り離すことによりハードな国境を回避し、その取り決めの存続を北アイルランド地域議会に委ねたのである。 On 31 January in 2020, the UK withdrew from the EU. It follows that the UK law is separated from the EU legal order, which means that the EU rules on the Single Market including the Customs Union does not apply to the UK any longer. But in order to maintain the Northern Ireland peace process and prevent a recurrence of violent conflict, it is required that the free movement of persons and goods between Northern Ireland and the Republic of Ireland should be ensured, which means avoiding a hard border between them. While the free movement of persons is maintained through the Common Travel Area between the UK and Ireland, it is necessary to keep Northern Ireland at least within the Single Market including the Customs Union in terms of the free movement of goods. In other words, Northern Ireland continues to be subject to the EU law and the jurisdiction of the CJEU even after Brexit. Both Ms. May, former UK Prime Minister and Mr. Johnson, present PM had the same position in terms of achieving withdrawal from the Single Market and the Customs Union. Ms. May pursued economic benefits more than legal independence from the EU by keeping alignment with the EU law after Brexit, while Mr. Johnson insisted upon "taking back control" from the EU and emphasized the recovery of sovereignty. However, to fulfil his policy goal, Mr. Johnson had no option but to separate Northern Ireland from the UK mainland and leaving it virtually subject to the EU law, in return for giving the assembly of Northern Ireland the veto power over the arrangements regularly.
