• Note (General): type:text; 本研究は、憲法上の権利の制限と内容形成に関する解釈論を発展させることを目的とする。（基本権の）内容形成とは、ドイツにおいて、基本権と法律が親和的な関係に立つ場合を主たるメルクマールとして展開される議論である。日本においても、最高裁判所が平成27 年の大法廷判決において、夫婦同氏制を定める民法750 条が憲法13 条、14 条1 項、24 条等に違反しないと判示した（最大判平成27・12・16 民集69 巻8 号2586 頁）。この判決では、氏名権や婚姻の自由といった権利が、法律による制限に対抗する権利ではなく、法制度に依存した、婚姻制度の枠内での権利であると捉えられた。この判決からもわかるように、基本権内容形成の議論は日本においても重要であるといえる。もっとも、この判決では権利を制度へと安易に従属させている点は批判されるべきであろう。もとより、基本権解釈において権利論と制度論のいずれに振り分けるかは難問である。 2年計画の研究のうち2年目に当たる2019年度は、積極的に私見を示すことに取り組んだ。とりわけ、権利論と制度論の境界が問題となる場面について、これを「憲法上の原形の不存在」という観点から整理し、解釈論を提示した。そのうえで、権利が法制度に依存する場合であっても、平等権や実体的権利の審査が問題となりうることを指摘した（小山剛「憲法にとって私法はどこまで特殊か」ドイツ憲法判例研究会編（小山剛編集代表）『憲法の規範力と市民法（講座 憲法の規範力 第3巻）』（信山社、2020年）9頁以下を参照）。 日本の最高裁において権利論と制度論が交錯した最近の事例であるNHK受信料判決（最大判平成29年12月6日民集71巻10号1817頁）についても検討を加え、本研究の成果を踏まえた私見を公表した（小山剛「NHK受信料制度の合憲性」長谷部恭男＝石川健治＝宍戸常寿編『憲法判例百選Ⅰ〔第7版〕』（有斐閣、2019年）167頁以下）。 This research aims to develop the theory on the restrictions on constitutional rights and the design of these rights (Ausgestaltung). The design of constitutional rights is the theory in Germany which is claimed when the constitutional rights and legislation have affinities with each other. In Japan, the Supreme Court held in 2015, that Article 750 of the Civil Code, which requiring spouses to have the same surname, does not violate Article 13, 14(1), 24 and so forth of the Constitution. This judgment saw the rights to name and marriage are not ones which counter the restrictions through legislation, but which depend on legal institutions and guaranteed only within the marital system. As we can see in this case, the discussion of the design of constitutional rights plays a great role in Japan too. This case, however, should be criticized for easily subordinating the right to the institution. To be sure, it is a difficult question, whether particular constitutional rights should be interpreted in the theory of rights or the theory of institutions. This year, I presented my views on the issue above to complete this two-year research project. Above all, I showed in some articles my way to interpret some cases in which the boundaries between the theory of rights and institutions would be critical. On this issue, I suggested, from the perspective of "the absence of constitutional archetypes", that even in the cases in which the rights depend on the legal institutions, the equal rights and substantive rights would be examined (Go Koyama, How is Constitutional Law Special to Civil Law?; in Doitsu Kenpo Hanrei Kenkyukai (Forshungsgesellschaft für deutsches Verfassungsrecht) (ed.), THE NORMATIVE POWER OF THE CONSTITUTION AND CIVIL LAW, (Shinzansha, 2020), at 9-29.). Following these general principles, I also released my analysis on the recent case by the Supreme Court.
