• Note (General): type:text; 現在わが国において，触法精神障害者の量刑がどのように評価され，その背景にある刑罰思想がいかなるものなのかが問題となっている。しかし，ドイツの議論を参考に展開されてきたこれまでの量刑理論は，抽象的な議論にとどまっており，裁判実務において，これらを直接的な指針として用いることは困難である。これまでの量刑理論は，「責任とは何か」という形而上学的な命題から演繹的に導出された基準を提示することに終始し，実務における理論の適用可能性を度外視する傾向があったためである。 本研究は，イギリス（イングランド・ウェールズ）刑法における量刑論について，現地でのリサーチ等を通じて歴史的背景や理論的根拠を対象とした研究を行うことにより，近時の実務で大きな問題となっている，触法精神障害者に対する量刑の判断枠組みを明らかにすることを目的としている。 本年度は，３ヵ年の研究計画のうち，わが国における量刑に関する文献資料の収集・分析に軸足を置き，特に裁判員制度の導入を契機として公表された刑事裁判官による論稿を検討対象とした。これらを整理・分析することで，わが国の量刑論と実務における判断プロセスの齟齬を認識し，比較法における分析対象を一定程度明確にした。 At present, in our country, how the sentencing of mentally disordered offenders should be evaluated, and what kind of punishment thought in the background has been discussed. However, the sentencing theory developed so far with reference to the discussion in Germany remains an abstract discussion, and it is difficult to use these as direct guidelines in court practice. This is because the conventional sentencing theory only presents a criterion derived deductively from the metaphysical proposition of "what is responsibility", and tends to ignore the applicability of the theory in practice. On the other hand, the purpose of this study is to clarify the judgment framework of sentencing for persons with mental disorders under the law by carrying out research on the sentencing theory in the British (England and Wales) sentencing law based on historical backgrounds and theoretical grounds through field research, etc. In this fiscal year, this research focused on the collection and analysis of documents related to sentencing in Japan. By arranging and analyzing these, the discrepancy of sentencing theory of our country and judgment process in the practice was recognized, and the analysis object in the comparison method was clarified to some extent.
