• Note (General): type:text; 本研究は，グローバル化が進む中，民法の整備をめぐる国際協力を通じ，一般市民の人格権と財産権を保護して労働へのインセンティブを高めることにより，より多くの市民が民法整備の成果を享受することができるインクルーシブな発展を可能にする制度改革の方法とプロセスを，開発法学の視点から探求することを目的とする。そのために本研究は，ベトナム，ラオスおよびカンボジアを題材にして，各国における民法整備への協力方法の相違が，民法の普及を通じた市民の権利の保護・実現，それによる市民の活動の自由の増大等にどのような相違を生じているかを明らかにすることを試みた。 本年度はカンボジアに焦点を当て，民法整備支援のカンボジア型の特色を考察した。内戦が続いたカンボジアでは，1993 年憲法による立憲君主制復活から間もなく，民法制定のための共同研究会方式による起草作業が始まった。民法は2007 年に成立したが，異なる支援機関が関与した法律間の抵触を調整するための2011 年民法施行法をもって施行された。日本の民法および民法学の到達点を反映したカンボジア民法整備協力は，1305か条からなる極めて精緻で国際標準を満たした革新的内容の民法をもたらした。それだけに，その普及に向けた取り組みにおいても，依然として日本の支援が求められており，また，民法の規定を反映した不動産登記法の起草についても支援が行われている。その一方で，この民法を国民化し，カンボジア人の，カンボジア人による，カンボジア人のための民法とするための大学，裁判所，検察院，弁護士会等，カンボジア国民による自発的な取り組みが待たれる状況にある。また，革新的な民法と既存の取引実務や伝統的な制度との間には乖離も見られる。カンボジア型の民法整備協力は，相手国における既存の実務慣行や伝統を踏まえ，相手国自身による法律の起草と普及のプロセスに協力することと，法律の内容的水準を確保することとの間のジレンマを示している。その解決方法を見出すことが，今後の民法整備協力の重要な課題である。 The purpose of this study is to explore, from the law and development perspective, the method and process of institutional reform that will enable inclusive development in which more citizens can enjoy the fruits of civil law development by protecting the personality rights and property rights of ordinary citizens and increasing their incentives to work through the international cooperation on civil law development in an increasingly globalized world. For this purpose, this study focuses on Vietnam, Lao PDR, and Cambodia in order to clarify how the differences in cooperation method for civil law development in each country influence the protection and realization of citizens' rights through the dissemination of civil law and the increase of citizens' freedom of action. This year, I focused on Cambodia and examined the features of the Cambodian model of civil law development cooperation. In Cambodia, where the civil war continued, the drafting of the Civil Code by the Joint Study Group started soon after the restoration of the constitutional monarchy by the 1993 Constitution. The Civil Code was enacted in 2007, but it came into effect with the Civil Code Enforcement Law of 2011 to reconcile conflicts between laws involving different donor agencies. The cooperation for the development of the Cambodian Civil Code, which reflects the achievements of the Japanese Civil Code and Jurisprudence, has resulted in an innovative Civil Code with 1305 sections, which is extremely precise and meets international standards. For this reason, Japan's support is still required in the efforts to disseminate it, and cooperation is also being provided in the drafting of the Immovable Property Registration Law, which reflects the provisions of the Civil Code. At the same time, there is a need for voluntary efforts by the Cambodian people, including universities, courts, prosecutors' offices, and bar associations, to nationalize the Civil Code and make it a civil code of the Cambodian people, by the Cambodian people, and for the Cambodian people. In addition, there is a gap between the innovative civil law and the existing transaction practices and traditional institutions. Cambodian-style cooperation for the development of civil law presents a dilemma between supporting the process of drafting and disseminating the law by the recipient itself, given the existing practices and traditions in the recipient country, and ensuring the content level of the law. Finding a solution to this dilemma is an important issue for future civil law development cooperation.
