英EUの貿易･協力協定（TCA）の交渉はブレグジット後の英EU関係をどのように定義するかをめぐって展開された。そこでは、イギリスの「主権回復」とEUの「単一市場の一体性」が対立した。イギリスの「主権回復」とは、EUを離脱したからにはEU法秩序には一切拘束されないとの主張であり、イギリスは英EU関係を純粋に国際法に基づく関係として定義しようとした。他方、EUの「単一市場の一体性」とは単一市場における権利と義務は不可分であり、単一市場で経済的利益を得たいのであればEU法秩序に従うべきであるという立場である。イギリスは経済的利益よりも主権回復を最優先し、EUの物品規制を受け入れることよる非関税障壁の回避、金融サービスでの単一パスポート制度など、EU法秩序に従うことから生じる経済的恩恵をほとんど手放した。また、英EU交渉の最後までもめた争点である「公正な競争環境（level playing field）」背景には「主権回復」をめぐる対立があった。EUは社会・労働保護、環境・気候保護、政府補助金規制などで、イギリスがEU法秩序の基準に合わせるよう要求したが、イギリスはそれを一切拒否した。両者の妥協点は国際法に基づく解決手続きであり、EU司法裁判所の役割は一切ないものである。すなわち、公正な競争環境に関する規制において英EU間に著しい乖離が生じて損害が発生する場合、被害を受けた側は関税賦課による報復などの「均衡回復」措置を一方的にとることができることとした。他方の当事者は仲裁審判所を設置して、それが妥当かどうかの判断を要求することができる。それに加えて、英EUは権利義務の適切なバランスを保つため、貿易・協力規定の発効から４年後に貿易規定などの運用についての見直しを要請することができ、改正が必要なら交渉が始まるが、１年以内に改正しないと英EUは貿易規定などの終了を通告することができる。このように、TCAは暫定取り決であり、一時休戦状態にすぎない。 The EU-UK relationship after Brexit is based on the Trade and Cooperation Agreement (TCA), which was negotiated in the conflict between the EU's position of "the integrity of the Single Market" and the UK's assertion of "Take Back Control". The former means that UK should be subject to the EU legal order if UK continue to ensure economic benefits after Brexit, while the latter shows that UK's sovereignty must precede economic benefits from the Single Market with EU rules. The TCA is a compromise between EU and UK, in which EU succeeded in maintaining "the integrity of the Single Market" and UK achieved a relationship with EU based on international law outside the EU legal order. It is a "modus vivendi" which has lots of unsolved issues. Consequently, the EU-UK relationship remains to be unstable.
