• Note (General): type:text; EUにおいては、デジタル化への対応等の政策課題を達成するため、数十年間にわたり、著作権法分野の法統一が図られてきた。統一の手法としては、域内の単一の著作権制度を立法するのではなく、各国の著作権制度を維持しつつ、EU指令を各国が国内法化するという形式が採用されている。指令は各国の国内裁判所において直接適用されるのではなく、各国の著作権法を通じて、間接的に適用されるにすぎない。各国において著作権法に関する紛争が発生すると、当該国の裁判所は、適用される法（著作物の利用地の法。多くの場合は当該国の著作権法）を解釈運用することになるが、その際、当該著作権法に国内法化されたEU指令の解釈が問題となることがある。この際、当該裁判所は、裁判手続を中止し、EU司法裁判所に指令の解釈についての先行判決（先決裁定ともいう）を求めることができる。近時、著作権法分野のEU指令が増えたことに伴い、先行判決も増加しており、EU司法裁判所による著作権法分野の法創造に国際的に注目が集まっており、この点に焦点を当てた研究も複数現れている。本年度は、EU著作権法関連の文献を分析し、次年度以降のより詳細な検討の準備を中心に行った。著作物性、著作権の内容、権利制限等主要な論点について、多数の先行判決が下されており、各事案ごとに、検討を進めている。EUと日本は、同じ国際条約の枠の中にあり、EUの事案解決は、日本法の解釈においても、参考とすべき点が多いことが明らかになりつつある。具体的成果については、次年度以降に、所属の部局の紀要等に公表する予定である。 In the EU, legal unification in the field of copyright law has been attempted for decades in order to achieve policy issues such as responding to digitalization. As a method of unification, instead of enacting a single copyright system in the region, each country adopts a form in which each country transposes EU directives while maintaining the copyright system of each country. The directive does not apply directly in the national courts of each country, but only indirectly through the copyright laws of each country. When a dispute concerning copyright law occurs in each country, the court of that country will interpret and operate the applicable law (the law of the place of use of the work, in many cases the copyright law of that country). At that time, the interpretation of the EU directive, which has been made into a domestic law in the copyright law, may be a problem. At this time, the court may suspend the court proceedings and request the EU Court of Justice for a prior judgment (also referred to as a prior judgment) regarding the interpretation of the directive. Recently, with the increase in EU directives in the field of copyright law, the number of prior judgments has also increased, and international attention has been focused on the creation of law in the field of copyright law by the EU Court of Justice. Several studies have also appeared. This year, we analyzed the literature related to EU copyright law and focused on preparing for a more detailed examination from the next year onward. A number of prior judgments have been made on major issues such as copyright characteristics, copyright content, and rights restrictions, and we are proceeding with consideration for each case. The EU and Japan are within the same framework of international treaties, and it is becoming clear that the resolution of EU cases should be referred to in the interpretation of Japanese law. Specific results will be announced in the bulletins of the departments to which they belong from the next fiscal year onward.
